Terms of Service & Refund Policy

Version: services.2026-09-12 · Applies when identified in your accepted written scope. Previously accepted scopes retain their applicable terms.

Naming clarification: Proof Frame is the public-facing name for the same $49 Listing Lock proof service covered by these terms. The clarification does not change its price, deliverables, review allowance, source requirements, or either party's duties.

1. Who we are

KINETIK is a beauty campaign launchpad and creative studio operated by Sai Parivar LLC ("KINETIK", "we"). Contact: hello@kinetik.beauty. By purchasing an offer or accepting a custom scope, you agree to these terms.

2. What we make

We plan and create beauty campaign assets from an accepted launch brief and approved images or reviewed representations of your real product. Work may include stills, short motion, agreed channel formats, creative notes, and a digital campaign handoff. In our source-locked composite lane, we preserve the supplied product and protected label regions while creating the scene, crop, light integration, grounding, and restrained motion around them. Adaptive concepts, premium-video providers, and digital twins may reconstruct more of the product or scene and are separately disclosed, scoped, cost-capped, and approved. Final outputs are reviewed by a human before delivery.

We do not create synthetic human spokespeople, medical or efficacy claims, or imagery intended to mislead. We may decline any request at our discretion, with a full refund of any amount paid for the declined work.

Scope and examples: Before payment, the accepted written scope identifies the products, production method, deliverables, durations, aspect ratios, generation and delivery resolution, revision allowance, timing, and any separately approved external-production cap. Gallery examples illustrate creative direction; they do not add deliverables or promise an identical result for a different product. Specific features included in your accepted scope remain our responsibility.

AI-assisted output: Generative methods may reconstruct parts of a scene and vary between attempts. Source quality, available viewpoints, materials, and technical limitations affect feasibility. We identify material limitations before accepting work. Recorded protected product details and technical specifications remain our review criteria; AI limitations do not excuse work that fails the accepted scope. If a treatment cannot reasonably meet it, we will propose an agreed alternative or apply the correction and refund provisions below. We do not knowingly present invented product features or unsupported claims as fact.

We distinguish upscaled delivery from native generation resolution. We do not guarantee that AI-generated elements are unique, eligible for copyright registration, or accepted by an advertising platform. Customer proofing and any platform-required disclosures do not replace our human review obligations or your non-excludable rights.

3. Source-fit check and current offers

The free source-fit check assesses whether the submitted photos are suitable for the requested work. It does not include a finished image or motion asset.

• Proof Frame: one approved label-safe still for one product, two crops of that same frame, one revision round, and human QA. The paid proof is credited toward a Beauty Launch Pilot purchased within 14 days.
• Beauty Launch Pilot: three finished stills and two deterministic living-motion clips for one product, with 9:16 and 1:1 exports, one revision round, and human QA. A premium-video treatment is included only when the accepted written scope explicitly replaces or adds a deliverable and states its provider and direct-cost cap.
• Beauty Campaign Pack: up to two products, six finished stills, four short motion clips, agreed platform crops, and two revision rounds across the pack. The written scope accepted before payment specifies whether the motion is deterministic, generative, or a combination, together with clip durations, formats, and any named external provider and direct-cost cap. A directed long-form commercial is not included unless expressly added in that scope.
• Beauty Launch System: recurring direction, adaptive concepts, premium short-form video, digital twins, novel viewpoints, or other custom work defined in a separate written scope.
• Creative Partner: $1,500 per paid month for a monthly creative plan, two scheduled content drops, up to two products, up to 12 finished product images, up to eight short living-motion clips, approved platform crops, two review rounds per monthly drop, priority scheduling, a private workspace, and up to $100 of named external production when included in the accepted monthly scope. External processing requires separate provider consent. The included allowance is not a cash credit and does not roll over. Models, paid media, studio shoots, and external-production spend above the accepted cap are separate written scopes and approved costs.

Crops and alternate exports of one approved frame are not separate creative concepts. A new product, viewpoint, set direction, or production representation may be scoped as new work.

4. Your uploads

You confirm that the products and images you send us are yours, or that you have the right to have them photographed, processed, and represented in the requested work. We cannot accept products or branding you do not have rights to. Uploaded images are used only to assess source fit and produce the accepted deliverables. We will request specific consent before sending customer source material to a named external generation provider.

5. Delivery and turnaround

Deliverables are sent digitally through the delivery route identified in the accepted scope. A campaign handoff may include accepted files, agreed channel formats, creative notes, and a usage or production receipt. The delivery schedule is confirmed after source and scope acceptance. Source quality, missing viewpoints, material complexity, provider availability, and review response time may affect the schedule; if we anticipate a meaningful delay we will tell you promptly.

6. Revisions

Each offer includes the revision round(s) stated in its description or written scope. Revision requests should be specific (scene, crop, lighting, motion, or copy). Revisions address the approved direction's execution; a different viewpoint, product, set concept, or production representation may be scoped as new work.

What one round means: One creative revision round is a consolidated written feedback list from your nominated approver against an identified proof batch, within the approved direction. Feedback received before we start that round may be combined into it. Feedback added after implementation begins may use the next available round; we will explain this before starting chargeable additional work. Standard pack allowances apply across the agreed pack, not separately to every file. Creative Partner retains two rounds per scheduled drop. If delivery is staged, the accepted scope states how rounds are allocated.

Our corrections do not use your creative rounds: Missing or corrupted files, incorrect agreed dimensions, unauthorized claims, material changes to protected product details, or failure to implement accepted feedback are corrections. We will correct our failure to meet the accepted scope without an additional creative-revision charge or apply the remedies in section 8. This does not promise unlimited changes of direction or technically impossible results.

New work: New products or packaging, added scenes, a changed approved script or visual world, extra languages, duration, or formats may need a written change order. We agree its price and timing before starting. A failed generation attempt does not automatically create an extra customer charge. Ordinary attempts needed to execute fixed-price scope and included revisions remain our responsibility; separately scoped exploratory work must be disclosed and capped before payment.

Feedback and acceptance: Your scope states the feedback schedule. Delays may require a communicated pause or revised delivery date. Silence is not acceptance and does not waive defect remedies or authorize public use. Final acceptance identifies the deliverable version and your authorized approver. Treatment or keyframe approval fixes the creative direction, not defects in unseen final work.

7. Usage rights

You retain your rights in supplied source materials. Once an accepted scope is paid in full, you receive the commercial usage rights KINETIK can lawfully grant for the placements identified in that scope, including any agreed ads, product pages, social, marketplaces, and print. We disclose material third-party license restrictions before scope acceptance. Stock assets, music, fonts, likenesses, pre-existing tools, and AI-generated elements may carry different rights. Commercial permission is not a guarantee of exclusive copyright, trademark clearance, or copyrightability. We only feature your product or your before/after publicly with your separate written permission, and we honor a no.

8. Refunds

Our refund promise: you should never pay for work that did not happen, that you did not approve, or that does not match what we agreed in writing. This policy explains exactly when money comes back to you.

• Any time before work starts: full refund, no questions, no form to fill.
• During production, before proofs are sent: full refund of any amount for work not yet delivered.
• After you see proofs: if the proofs miss the accepted written scope, you can request a full refund or free revisions; your choice. Proof watermarks are removed only after payment clears.
• After delivery: we fix issues through the included revisions first. If we cannot deliver work that matches the offer description or accepted written scope, we will refund the affected portion or the full amount, whichever is fair to you.
• If we decline your brief: full refund of anything paid for the declined work, automatically.
• If we cannot deliver at all: full refund, plus you keep any source materials you provided.

Timing: refund decisions are made within 2 business days of your email. Approved refunds are returned to the original payment method via Stripe, typically arriving in 5 to 10 business days depending on your bank.

How to ask: email hello@kinetik.beauty with your order reference. Because deliverables are custom digital work, situations outside the list above are handled case by case in good faith; we will make it right or make it clear.

9. Monthly plans

Creative Partner is approved and paid one monthly scope at a time. Each month's written scope and price require your acceptance before its one-time payment. We do not automatically renew the service or charge your saved payment method for another month. You may choose not to approve the next month; no cancellation is required to prevent a future charge. Changes or cancellation of an already paid scope remain subject to the revision and refund provisions above.

10. No performance guarantees

We deliver creative assets. We do not guarantee sales, ad performance, engagement, or any business outcome from using them.

11. Payments

Payments are processed by Stripe; we never see or store your card details. Prices are in USD. Applicable taxes, where required, are shown at checkout. A custom scope may separate a capped direct-production allowance from the KINETIK creative, QA, revision, and handoff fee. We do not exceed an accepted external-production cap without additional written approval.

12. Liability

To the maximum extent permitted by law, our total liability for any claim related to a purchase is limited to the amount you paid for that purchase.

13. Changes and law

We may update these terms; the date above reflects the current version, and the version in force when you purchase applies to that purchase. These terms are governed by the laws of the state where Sai Parivar LLC is organized, without regard to conflict-of-law rules.
